A federal judge in Washington, D.C. has ruled against the Trump administration’s expanded use of expedited removal — a process that allows migrants to be deported quickly without seeing a judge.
Judge Jia Cobb said the administration’s policy of detaining immigrants anywhere in the country without due process was unlawful, calling it a violation of constitutional protections.
This decision is a major blow to Trump’s deportation agenda, although it may be temporary pending appeal.
Under Biden, expedited removals were limited mostly to recent border crossers.
Under Trump, the policy was expanded nationwide, sometimes denying migrants the chance to appear before a judge.
The ruling emphasizes that due process applies to everyone, citizens and noncitizens alike.
