From Melbourne Mayor Paul Alfrey’s Facebook Page:
On Tuesday night I will present a proposed ordinance through our City Attorney’s Office, that protects the safe use of streets by restricting the physical interaction between a pedestrian and an occupant of a motor vehicle.
This ordinance applies to both the “giver” and “acceptor” of an exchange. The fines and criminal punishment will be discussed by Council, however, fines up to $500 and/or incarceration of up to 60 days will be considered.
In short, if an exchange with a pedestrian and a vehicle occupant is to occur, it will remain legal if it is out of the travel lane or on private property. The link to the full ordinance is here.
