Cocoa Police Arrest 33-Year-Old Man for Lewd Battery, Soliciting Minor for Sex

A 33-year-old Cocoa man has been charged with three felonies after Cocoa Police investigators determined he had been having sex with a juvenile runaway who is a verified Child Sex Trafficking Victim with documented cases in Florida, Georgia, and multiple Florida counties.

Marquis Daniel Wall faces charges of Lewd or Lascivious Battery, Traveling to Meet a Minor under, and Solicitation of a Minor Using an Electronic Device.

Missing Runaway Located With Suspect

The investigation began on March 16, 2026, when Cocoa Police Officer Flowers responded to a call regarding a juvenile, identified in court records only by the initials R.J., who had been reported as a missing runaway. While Officer Flowers was entering the juvenile into the missing persons system, Cocoa Police received a separate report that the juvenile had been located in a courtyard area.

According to the affidavit, the victim has documented history in both Florida and Georgia for verified findings of sex trafficking. She also has an open Sexual Battery case with the Brevard County Sheriff’s Office and an open child sex trafficking case in Orange County.

Suspect Admitted to Sexual Contact

When officers made contact, the victim was visibly upset and disclosed she had been having sex with a man who had gotten her pregnant. The man, identified as Wall, was on scene at the time officers arrived.

According to the sworn affidavit, Wall admitted to Officer Flowers that he had been having sex with the victim and showed officers text messages he claimed came from her. Wall told officers the victim had sent him a message stating she was 18 years old. Body-worn camera footage captured Wall apologizing to the victim’s family for “not knowing she wasn’t 18.”

The victim was found wearing Wall’s boxer briefs, according to the affidavit.

Pregnancy, Multiple Encounters, Out-of-County Travel

The victim disclosed she had been having sex with Wall for several weeks. She told officers the most recent encounter occurred on March 14, 2026, at an unknown apartment, and that she had also had sex with him at another location in the City of Cocoa.

The victim showed Officer Flowers a photograph on her phone displaying a positive pregnancy test. She stated she became pregnant due to sexual contact with Wall that began in early March 2026.

A forensic interview was conducted on March 17, 2026, at the Children’s Advocacy Center of Brevard. During that interview, the victim disclosed Wall had picked her up on a separate occasion and driven her to another location for sex. The affidavit also describes text messages in which Wall detailed plans to pick the victim up and take her to an Airbnb in Clermont, Florida, in Lake County.

Digital Evidence: Texts, Photos, Video

Investigators collected the victim’s clothing, text messages between the victim and Wall, and four videos that were uploaded into evidence at the Cocoa Police Department.

According to the affidavit, the text messages between Wall and the victim “discuss having sexual relations” and include photographs Wall sent of himself, including pictures of himself with his own children. The victim also exchanged photographs with Wall, including some in which she is shown nude.

The text messages, according to the affidavit, are “detailed in the suspects intentions to meet with her in person, pick her up in his vehicle and have sex with her.”

Surveillance video collected from the location showed Wall in and out of his vehicle in a parking lot. The victim positively identified both Wall and his vehicle from the recordings. Two oral buccal swabs were collected with consent from the victim.

Victim Reported Missing Twice More After Initial Incident

Since the March 16 incident, the juvenile has been reported missing on two additional occasions, with the most recent missing persons report filed on April 22, 2026. She was located the following day, April 23, 2026, at the same location where the original incident occurred.

“The suspect in this case is believed to possibly still be attempting to contact the juvenile victim,” the affidavit states.

The victim’s cellphone has been collected by the Metropolitan Bureau of Investigations Human Trafficking Unit in connection with the open Orange County case. A forensic download of the device is pending.

About the Investigating Detective

The affidavit was sworn by Cocoa Police Detective Amanda Torello, who has been employed by the Cocoa Police Department since April 2015 and assigned to the Criminal Investigations Division as a detective since July 2023. According to the affidavit, Detective Torello is an investigative member of the Internet Crimes Against Children (ICAC) Task Force for the North Florida Region. She has completed Florida Department of Law Enforcement training in Adult Sex Crimes, Child Sex Crimes, Juvenile Sexual Offender Investigations, and Human Trafficking. Detective Torello was named Detective of the 4th Quarter 2025 by the Cocoa Police Department.

The Charges

Lewd or Lascivious Battery under Florida Statute 800.04(6)(b) is a second-degree felony punishable by up to 15 years in state prison.

Traveling to Meet a Minor under Florida Statute 847.0135(4) is a second-degree felony punishable by up to 15 years in state prison and is one of Florida’s most aggressively prosecuted internet sex offenses.

Solicitation of a Minor Using an Electronic Device under Florida Statute 847.0135 is a third-degree felony punishable by up to 5 years in state prison.

All defendants are presumed innocent until proven guilty in a court of law.
