Intoxicated Argument in Melbourne Home Ends With Man Shot in Leg

MELBOURNE, Fla. – A Brevard County man has been arrested after deputies say he shot another man during an argument inside a Melbourne home early Saturday morning.

According to an affidavit filed by the Brevard County Sheriff’s Office, deputies responded to a 911 call at approximately 1:46 a.m. on August 23, 2025. The caller, later identified as Marquis Daniel Wall, 32, admitted on the call that he had shot a man but stated he did not intend to kill him.

The Incident

When deputies arrived at 611 Nevada Street, they found two men and a woman outside the residence. One of the men, identified as Wall, allegedly told deputies, “I shot… it’s my gun.” Deputies later located a silver Taurus revolver under a nearby vehicle.

Inside the home, officers discovered Tyrone Levon Henderson, 27, lying on the kitchen floor in a pool of blood with a gunshot wound to his left leg. Henderson was alive but unresponsive. Brevard County Fire Rescue paramedics treated him on scene before transporting him to Holmes Regional Medical Center.

Also present was Wall’s twin brother, Marcus Xavier Wall, and a woman. Marcus Wall told investigators he witnessed the shooting and confirmed that Henderson and Marquis Wall had been arguing when the incident occurred.

Argument Turns Violent

The affidavit states that both Wall and Henderson had been drinking and were intoxicated when the argument began. Witnesses said Henderson became “verbally hostile and belligerent,” continuing to berate Wall. At one point, Henderson allegedly grabbed Wall by the neck, prompting Wall to push him away and attempt to leave the residence.

Before leaving, Wall retrieved his firearm from a kitchen cabinet and attempted to stow it in his sling bag. Henderson allegedly continued to pursue him. According to Wall’s statement to investigators, he turned back and fired his revolver in Henderson’s direction, striking him in the leg.

Wall later told deputies he intentionally aimed for Henderson’s legs, stating he “did not want to kill him” but was “tired of Henderson’s constant badgering” and felt unable to reason with him.

Charges Filed

Based on evidence, witness statements, and Wall’s own admissions, deputies obtained an arrest warrant charging Marquis Daniel Wall with multiple offenses, including:

  • Aggravated Battery (Florida Statute 784.045(1)(a))
  • Discharging a Firearm on Residential Property (Florida Statute 790.15)
  • Using a Firearm Under the Influence (Florida Statute 790.151)

Wall was taken into custody and booked into the Brevard County Jail. Henderson remains hospitalized for treatment of his injuries.

Investigation Ongoing

The case is being handled by the Brevard County Sheriff’s Office Homicide Unit, which noted in the affidavit that Wall’s actions provided sufficient probable cause for the charges.
