In a civil suit filed back in March of this year by ABC Concrete, Inc. against a local nonprofit, the suit alleged that the nonprofit missed payments and submitted checks that were dishonored to a local contractor. City of Cocoa Mayoral candidate Bob Harvey, who is listed as the Chair for the local nonprofit and Councilwoman Brenda Warner who is listed as Vice Chair and Treasurer according to Sunbiz records have retained legal council according to public records.

Also according to public records Warner who is currently serving on Cocoa City Council voted during city council meetings to waive liens for the two properties outlined in the lawsuit for unpaid work. According to the Florida Commission on Ethics, Warner should have recused herself from voting since she is apart of the nonprofit regardless of being a volunteer.
