A Brevard County judge threw the book at a convicted sex offender this week, handing him more than double what his own attorney asked for.![]()
Circuit Judge Steve Henderson sentenced Aree Lafayette Spivey to 30 years in state prison on Tuesday, the maximum allowed, after a jury convicted him of sexual battery by physical force on a victim over the age of 12.![]()
The defense asked Henderson for 15 years, the minimum mandatory under Florida's Prison Releasee Reoffender law. Henderson went the full 30.![]()
Spivey had a chance to avoid this. Court records show he rejected the State's plea offer before trial, and a source familiar with the case says that offer was 10 years. Instead, he took his chances with a jury in Henderson's Viera courtroom.![]()
On Sept. 3, jurors found him guilty and also answered a special question: Did Spivey commit the crime within three years of being released from a Florida prison? Their answer was yes.![]()
That finding made him a Prison Releasee Reoffender, meaning he must serve 100 percent of his sentence with no parole, no early release and no gain time. Henderson also designated him a Habitual Felony Offender, which allowed the judge to double the normal 15-year cap for a second-degree felony to 30 years.![]()
Spivey was arrested in June 2023. Henderson denied his motions for a new trial and judgment of acquittal, and the Public Defender has been appointed to handle his appeal. He was given credit for 90#BrevardCounty

Tropical Storm Isaias formed early Wednesday in the southwestern Gulf, becoming the ninth named storm of the 2026 Atlantic hurricane season.![]()
As of the National Hurricane Center's 5 a.m. Eastern advisory, Isaias was about 285 miles west of Progreso, Mexico, with maximum sustained winds of 40 mph. It is moving east-northeast at 8 mph.![]()
Forecasters expect rapid strengthening over the next day or two. Isaias is forecast to become a hurricane Thursday, which would make it the first hurricane of the Atlantic season, and could reach Category 2 strength with 100 mph winds by Friday.![]()
