Smith, of Mims, was booked at 2:06 a.m. Friday, Oct. 2, on one count of aggravated assault with a deadly weapon without intent to kill, according to Brevard County Sheriff’s Office jail records. The charge is a third-degree felony under Florida Statute 784.021. Jail records list his bond as “No Bond” as of Friday morning.

According to the arrest affidavit, officers responded on Oct. 1 to the Circle K at 1500 N. Singleton Ave. in reference to an aggravated assault. The victim gave a sworn statement.

The victim told police he had attended an event at Astronaut High School on War Eagle Boulevard with several friends. Two of his friends confronted a female about a dating relationship, and the two groups parted ways after the confrontation, the affidavit states.

When the event ended, the victim drove his gray Nissan pickup away from the school with friends inside, while a second group of friends followed in a white Cadillac.

As the victim drove east on Dairy Road, a white 2023 Ford F-350 began driving aggressively and caused the victim to be driven off the roadway onto the grass shoulder, according to the affidavit. The victim pulled into the Dollar Tree at 3333 Dairy Rd., and the Ford followed. The Cadillac stayed nearby.

When the victim got out of his truck, he was confronted by the driver of the Ford, whom he immediately recognized as Carmine Smith, the affidavit states. The victim told police he heard the sound of a firearm being chambered, then saw Smith raise and point a tan, Glock-style firearm with an extended magazine at him.

Smith then chased the victim around the vehicles while stating he was going to shoot everyone, according to the affidavit. The parties separated shortly afterward.

A witness provided a sworn statement describing the same details as the victim, police wrote.

Smith’s Account

Officers located Smith at his Mims residence, where he was detained and interviewed after being read his Miranda rights.

Smith told police he saw his sister being confronted by a group of about eight people who were calling her derogatory names. He said his sister came to him and told him what happened, and the group broke up, according to the affidavit.

Smith said he later got into his white Ford with a small group, and that an unknown male placed a tan airsoft gun in the cabin of the truck.

According to Smith’s account, the gray Nissan accelerated and passed him on Dairy Road near James Madison Middle School, then cut in front of his truck and slammed on its brakes. Smith told police he responded by attempting the same maneuver, which caused the Nissan to go off the road. He said he followed the Nissan and the Cadillac into the Dollar Tree parking lot expecting a civil conversation.

Smith told police that once in the parking lot, he was surrounded by approximately eight people who were approaching him. He said he reached into his truck, grabbed the airsoft gun, and held it at his side pointed at the ground. He said he never verbally threatened anyone, walked around his truck to make sure he had room to safely leave, and then left.

Gaulding wrote that based on the information provided, he placed Smith under arrest. Smith was taken to the Titusville Police Department for a further interview by Detective D. Baker, then transported to the Brevard County Jail. The affidavit notes the investigation was captured on the officer’s body-worn camera.

Connection to the G&G Roofing Smuggling Case

Carmine Smith’s father, Raymond Neil Smith II, founded G&G Roofing in Rockledge. Raymond Smith was arrested in April 2024 on federal human smuggling charges and pleaded guilty on July 12, 2024, to conspiracy to smuggle aliens and unlawfully transporting aliens. Court records showed he smuggled at least 98 migrants, mostly Haitian and including unaccompanied children, between Florida and the Bahamas.

He was sentenced to 30 months in federal prison in May 2025. The Space Coast Rocket reported in May 2026 that Raymond Smith was already out of prison and in a halfway house after serving about nine months, and that he had acquired a new boat named “Flight Risk.”

Federal court records in Raymond Smith’s case described a minor assisting with the boat during the smuggling operation. The Space Coast Rocket has identified that minor as Carmine Smith. Carmine Smith was not charged in the federal case.

The charge against Carmine Smith is an accusation. He is presumed innocent unless and until proven guilty in a court of law.
