The arrest took place after an altercation early in the morning of October 12, when Burgos, frustrated over the lack of restored electricity at his residence, fired his gun indoors. This act of violence resulted in the fatal shooting of his dog, Flick.

Burgos, who was reportedly drinking at the time of the incident, became enraged when Florida Power & Light (FPL) had yet to restore power to his home, leading him to fire his gun inside his house.
