Clinton Daryl Davis II, 44, the owner of the downtown Melbourne bar Debauchery, was arrested early Tuesday morning in Cocoa Beach on DUI and drug charges.
Cocoa Beach Police Officer James Scheiner wrote that at about 1:15 a.m. on Sept. 22, he saw three vehicles traveling north on North Atlantic Avenue at 48 to 52 mph in a 35 mph zone. He briefly turned on his emergency lights to get them to slow down. Only one did.
The officer said he saw a dark-colored Ford pickup swerving from its lane into the median lane. Near 3300 North Atlantic Avenue, radar clocked the truck at about 60 mph in the 35 mph zone. The officer said the truck kept going north after he turned on his lights and siren. Past Ron Jon Surf Shop, it slowed sharply, turned on its right signal, moved into the left-turn lane, and drove onto the median with its left tires. Using his patrol car’s public-address system, the officer told the driver to pull over. The driver turned right at State Road 520 and stopped in the Ron Jon bus parking area.
The officer identified the driver, the only person in the 2023 Ford F-150, as Davis. The affidavit says a strong, sweet odor came from the truck, and a wet brown substance was on the passenger seat and door. Davis said he had not spilled anything. The officer wrote that Davis’s breath smelled of alcohol, his eyes were pink and bloodshot, and his pupils were enlarged.
On field sobriety exercises, the officer reported six of six clues on horizontal gaze nystagmus, three of eight on the walk-and-turn, and four of four on the one-leg stand. Davis was arrested for DUI. He refused a breath test after the officer read him the implied-consent warning.
The officer wrote that a search of Davis’s person turned up a plastic baggie with a white substance and two cut straws in a zippered pocket. The substance field-tested presumptive positive for cocaine. In the truck’s overhead eyeglass compartment, the officer said he found a torn and tied plastic bag containing 43 pills. Their markings matched oxycodone hydrochloride and acetaminophen in an online pill-identification database. One more matching pill was in the glove compartment. The officer also found a white plastic bottle of brown liquid that smelled like rum in the driver’s door, plus a metal mixing cup and a paper cup of liquid on the passenger floorboard.
The officer wrote that during the drive to the police station, the odor of alcohol coming from Davis filled the patrol car so strongly that he rolled down all the windows.
Davis faces charges of possession of a controlled substance without a prescription (oxycodone), a third-degree felony; purchase of a Schedule II controlled substance (cocaine), a second-degree felony; DUI; and refusal to submit to DUI testing. At his first appearance Tuesday afternoon, a judge found probable cause on the oxycodone, DUI and refusal charges but found no probable cause on the cocaine purchase count. Bond was set at $2,500 on the oxycodone charge, $5,000 on DUI and $500 on the refusal. Conditions bar him from driving without a valid license, possessing or drinking alcohol, and using or possessing illegal substances. His arraignment is set for Oct. 20 before Judge David Koenig at the Moore Justice Center in Viera.
The court appointed the Public Defender’s Office after the clerk found Davis indigent.
Tuesday’s arrest was not Davis’s first this year. Booking records show Melbourne police arrested Davis at 2:56 a.m. on March 24, 2026, and he was booked into the Brevard County Jail that morning on charges of cocaine possession and possession of drug paraphernalia.
In July 2023, a BCSO deputy stopped him at South Miramar Avenue and Tampa Avenue in Indialantic. The deputy wrote that he knew Davis was driving without a valid license, which had been suspended in February 2023 for failing to complete court-ordered school. According to that affidavit, with the deputy’s blue lights on, Davis got out of his black Dodge truck, approached the deputy, and asked what he wanted. He then walked away from the stop and pulled out his phone to make a call. Asked about mail from the county about his license, he told the deputy he never checks his mail. The deputy wrote that Davis ignored commands to stay at the scene and resisted being handcuffed by tensing his arms, until backup arrived. He was found guilty of driving without a valid license. Prosecutors dropped the resisting without violence charge.
Brevard County court records show this is at least the third time Davis has been charged with DUI. In 2002, a DUI charge was reduced to reckless driving, and he was found guilty. In 2005, he was charged with DUI and two counts of DUI with property damage. In 2008, the DUI counts were dropped and he was found guilty of reckless driving reduced from DUI.
He has also been found guilty of driving with a suspended license with knowledge (2006) and driving without a valid license (2019 and 2023). His record includes three disorderly conduct cases (2002, 2009 and 2012), a 2002 cannabis and paraphernalia case, and a 2007 City of Melbourne citation for patrons in a bar after hours, all dropped or with adjudication withheld. He has dozens of traffic infractions, including a 2022 citation for speeding 20 to 29 mph over the limit.
All charges are accusations. Davis is presumed innocent unless proven guilty in court.
